Terms of Service

These Terms of Service ("Terms") govern your access to and use of the KW Ventures & Consulting website located at kwventures.co and the coaching and professional development services provided by KW Ventures & Consulting ("KW Ventures," "we," "our," or "us"). By accessing our website, engaging our services, or otherwise interacting with us, you ("Client," "you," or "your") agree to be bound by these Terms.

Services

KW Ventures & Consulting provides career coaching and professional development services. We are not a recruiting, staffing, or placement agency and do not secure employment, submit applications on behalf of clients, or guarantee interviews, job offers, promotions, salary increases, or specific career outcomes. Our services are designed to provide education, strategy, guidance, and professional development to help clients navigate their career journey with confidence. Individual results will vary based on each client’s effort, experience, qualifications, and market conditions. All services are advisory in nature.

Client responsibilities

You agree to provide accurate and complete information, engage in good faith, attend scheduled sessions on time, and take responsibility for the professional decisions you make based on our guidance. You are responsible for maintaining a stable internet connection and a suitable environment for virtual sessions. Materials, feedback, and deliverables shared during an engagement are for your personal, non-commercial use and may not be redistributed, resold, or repurposed for training any third-party service.

Payment, cancellations, and refunds

Session and package fees are described at the time of booking and are due at the time of booking unless otherwise agreed in writing. Your session is not confirmed until payment has been successfully processed.

Cancellations and rescheduling are governed by our Cancellation & Refund Policy, which is incorporated into these Terms by reference. In summary, appointments may be canceled or rescheduled at no charge if requested more than 48 hours before the scheduled start time. Requests made within 48 hours of the appointment are not eligible for a refund and may not be rescheduled. Digital deliverables

Many services include personalized work completed outside of live sessions, including written recommendations, resume revisions, LinkedIn recommendations, interview preparation materials, career action plans, and other customized deliverables. Because work on these services often begins shortly after purchase, refunds may not be available once work has started or any deliverables have been provided, as further described in our Cancellation & Refund Policy.

Gift certificates

Gift certificates may be purchased in preset or custom amounts through our website and are delivered digitally. The following terms apply to all gift certificates issued by KW Ventures & Consulting:

• Gift certificates may be redeemed only toward eligible KW Ventures & Consulting coaching and professional development services.
• Gift certificates are not redeemable for cash except where required by applicable law.
• Gift certificate purchases are final and non-refundable once issued, unless otherwise required by law.
• Gift certificates may not be resold, transferred for value, altered, copied, or used fraudulently.
• Only one gift certificate code may be applied per booking. Any remaining balance after redemption will remain available on the same code for future eligible purchases until depleted.
• If the selected service exceeds the remaining gift certificate balance, the recipient is responsible for paying the difference at checkout.
• Lost, stolen, unauthorized, duplicated, or fraudulently obtained gift certificates are not the responsibility of KW Ventures & Consulting.
• KW Ventures & Consulting reserves the right to refuse, suspend, or cancel any gift certificate suspected of fraud, misuse, or unauthorized activity.

Services booked using a gift certificate remain subject to our Cancellation & Refund Policy.

Right to refuse or terminate services

KW Ventures & Consulting reserves the right to refuse, suspend, or terminate services at our sole discretion, including for abusive conduct, harassment, misrepresentation, non-payment, violation of these Terms, or any conduct that we reasonably believe interferes with our ability to provide services or with the experience of other clients. If we terminate an engagement for a reason unrelated to your conduct, we will refund any fees paid for services that have not yet been provided.

Confidentiality

We treat information you share during coaching engagements as confidential and use it solely to support your goals, except as required by law or as described in our Privacy Policy. You agree to treat any proprietary methodologies, frameworks, worksheets, or templates shared with you as confidential as well.

Intellectual property

All original content on this website — copy, images, design, and proprietary frameworks — and any personalized deliverables prepared for you are the property of KW Ventures & Consulting and may not be reproduced, distributed, or used to create derivative works without our prior written permission. You retain ownership of any personal information, resume content, or background you provide to us.

Third-party services

Our website and services use third-party providers, including payment processing (Stripe), scheduling and video meetings (Google Meet and Google Calendar), and email delivery services. Your use of those services is subject to the applicable third-party terms and privacy policies. KW Ventures & Consulting is not responsible for the availability, accuracy, or practices of third-party services.

Electronic communications

By providing your email address or phone number to KW Ventures & Consulting, you consent to receive service-related communications electronically, including booking confirmations, calendar invitations, reminders, payment receipts, deliverables, and administrative notices. You agree that all electronic communications, agreements, and notices satisfy any legal requirement that such communications be in writing.

Disclaimers & limitation of liability

Our services and website are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including any warranties of merchantability, fitness for a particular purpose, or non-infringement. We make no guarantees about specific career, financial, employment, interview, or performance outcomes.

To the maximum extent permitted by law, KW Ventures & Consulting will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of our services or website. Our total aggregate liability for any claim arising from these Terms or the services will not exceed the amount you paid to KW Ventures & Consulting for the specific service giving rise to the claim during the six (6) months preceding the event.

Governing law

These Terms are governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the services will be resolved exclusively in the state or federal courts located in North Carolina, and you consent to the personal jurisdiction of those courts.

Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.

Entire agreement

These Terms, together with the Privacy Policy and the Cancellation & Refund Policy, constitute the entire agreement between you and KW Ventures & Consulting regarding the use of our website and services and supersede any prior or contemporaneous agreements, communications, or understandings on the same subject matter.

Changes

We may update these Terms from time to time. The "Last Updated" date at the top of this page reflects the effective date of the most recent revision. Continued use of the site or services after an update constitutes acceptance of the revised Terms.
